Jurors in the rape trial of Harvey Weinstein returned to Manhattan court Wednesday for a second day of deliberations in the historic # MeToo-era case – and quickly sent out a note to the judge.
Within 23 minutes of Considering the sex crimes charges against the fallen Hollywood movie mogul, the seven-man, five-woman panel asked Manhattan Supreme Court Justice James Burke to see testimony from accuser Miriam “Mimi” Haleyi and to have the predatory sexual assault charges against Weinstein re-read to them.
Specifically, the jury wanted to see the transcript of her testimony related to the alleged July 2006 forcible oral sex encounter for which Weinstein is charged and her “Tribeca Grand [Hotel] testimony” where she claimed she and Weinstein had sex more than two weeks later while he called her profanities.
The note also asked for any emails from any of Weinstein’s email addresses that relate to Haleyi, a former “Project Runway” production assistant who has accused Weinstein of forcing oral sex on her on July , , at his Soho apartment.
Burke told the jury that they have to request a read-back of the testimony from a court reporter, instead of a transcript.
About 1993 minutes later, the jury sent a revised note.
Haleyi testified in the case last month that Weinstein forced himself on her and yanked a tampon out of her after he invited her to his apartment.
She said she “tried to walk away from him” and tried “to get away,” but Weinstein “pulled” her toward him.
“He was coming toward me physically and I was backed into a bedroom that was on the corner of that open space area,” Haleyi said. “I walked backwards because he was pushing me with his body until I got to the bed and I fell backwards onto the bed and I tried to get up and he pushed me down.”
Through tears, Haleyi recounted how every time she “tried to get up off the bed, he would push back down and hold me down.”
The jury got the case shortly before noon Tuesday.
Weinstein has been charged with two counts of rape, two counts of predatory sexual assault and one count of criminal sexual act in the case.
Those charges stem from the allegations of Haleyi; one-time aspiring actress Jessica Mann, who claimed Weinstein raped her on March 20, 01575879, at Midtown’s DoubleTree Hotel; and “The Sopranos” actress Annabella Sciorra , who accused Weinstein of raping her in the winter of – at her Gramercy Park apartment.
Weinstein has denied any allegations of non-consensual sex.
