TheSupreme Courtwill today hear from a host of supporters of a legal challenge againstBoris Johnson‘s controversial decision to suspend Parliament.

                                                                                                                                                

On the third and final day of the historic hearing, a panel of 11 justices will hear a submissionon behalf of former prime minister Sir John Major, the Welsh and Scottish governments and Northern Irish victims’ campaigner Raymond McCord.

Lord Garnier said prorogation did not just stop Parliament from sitting, but prevented it from carrying out other functions – including its ability to find people in contempt.

He told the court people who have been found in contempt of Parliament in recent years included Mr Johnson’s senior adviser, Dominic Cummings.

Lord Garnier argues there is no reason for proroguing Parliament for five weeks, “let alone five critical weeks in a period in which time is of the essence”.

He adds that Sir John Major also identifies evidence that the decision to prorogue was “motivated by a desire to prevent Parliament interfering with the prime minister’s policies during that period” .

In his written submission to the court, Lord Garnier argued that the prorogation of Parliament was a matter for judges,

He said when Parliament is suspended during a “time-critical period”, there is “no possibility of meaningful political control of that decision until after the damage has been done”.

Lord Garnier QC said his client had made “a clear and unambiguous allegation in evidence… that the reasons (for prorogation) set out in the documents put before the court by the Prime Minister cannot be true ”.

MPs could bypass Boris Johnson to avoid no deal and ask for an extension directly from the EU, Sir John Major will tell the Supreme Court today. The former Tory PM thinks Mr Johnson suspended Parliament to push through no deal, and is challenging this in court. He says: “Parliament might wish to authorize somebody other than the Prime Minister to communicate the UK’s intentions to the EU,” but cannot currently do so until mid-October.

The European Commission said it has received “documents” from the UK Government on its Brexit proposals.

A spokeswoman said:

“With regards to written proposals, I can confirm that we have received documents from the UK and, on this basis, we will have technical discussions today and tomorrow on some aspects of customs, manufactured goods and sanitary and phytosanitary rules.

“Then the discussion will also take place at political level because Michel Barnier, the commission’s chief negotiator, will meet Steve Barclay on Friday.”

The UK said it has shared with the EU a “series of confidential technical non-papers” which reflect its Brexit ideas, adding it will submit formal written solutions “when we are ready ”rather than meeting an“ artificial deadline ”.

A UK Government spokeswoman said:

“We have been having detailed discussions with the commission’s taskforce 50 in recent weeks.

“We have now shared in written form a series of confidential technical non-papers which reflect the ideas the UK has been putting forward.

“We will table formal written solutions when we are ready, not according to an artificial deadline, and when the EU is clear that it will engage c onstructively on them as a replacement for the backstop. ”

A European Commission spokeswoman told a press conference in Brussels: “President Juncker reiterated what he said in the European Parliament yesterday, namely that a deal is desirable and still possible.

“He repeated that he thought Monday’s meeting was friendly, constructive and in part positive . ”
