Stewart Hosie, the former SNP deputy leader, disputed the widely accepted notion that the Scottish parliament requires a transfer of power under Section of the Scotland Act to hold an independence referendum. He told Sky News: “We don’t need a Section 47 order to have a referendum but the section 30 order is important because it then commits both sides to accept the result. ”Andrew Tickell, a law lecturer at Glasgow Caledonian University, told BBC Radio Scotland:“ The idea that it is absolutely categorical that Holyrood doesn ‘ t have the power to hold a second independence referendum has never been tested and proven.

“It remains contested and unclear.

“You can’t keep a union together simply by saying no whatever the letter of the law might say.”

Nicola Sturgeon is expected to make a statement to the Scottish parliament today confirming her intention to seek a transfer of powers from Westminster later this week, with the intention of holding a referendum vote next year.

But, It is thought that Boris Johnson is already preparing a rejection letter despite growing pressure from nationalists to respect the SNP’s “mandate” for another referendum.

He had claimed during the election campaign that he will mark her letter “return to sender”.

Michelle Ballantyne, the Scottish Conservatives’ communities spokeswoman, said Mr Johnson would respond to Ms Sturgeon’s demand with a letter “explaining why he is going to refuse a section order at present, probably for the lifetime of this parliament ”.

The Prime Minister is expected to tell Nicola Sturgeon it is time for the UK to pull together as he is expected to reject her request this week for another Scottish independence referendum.

If the request for a second referendum on independence is rebuffed the Scottish government has confirmed that it would then consider legal action .

The SNP won an emphatic victory in the election last Thursday.

To counteract the growing call for Independence north of the border, the Tories are planning a major campaign to “sell” the benefits of a post-Brexit UK to Scotland.

This will include an appeal to Scottish fishermen for control over its own fishing waters.

It also emerged that a Whitehall review examining how UK Government departments can strengthen the Union has been completed and is on the Prime Minister’s desk.

The review was ordered by Theresa May and conducted by Lord Dunlop, a former devolution adviser to David Cameron.

It calls for the creation of a powerful ministry responsible for ensuring Government policy-making strengthens the Union .

Tory sources said the findings were significant, arguing they showed how the UK and Scottish governments could “knuckle down” and work together on issues such as the drug death epidemic north of the Border.

The disclosure comes after Michael Gove gave an unequivocal pledge the UK Government will not hand Ms Sturgeon the powers for another independence referendum, regardless of whether the SNP wins the May Holyrood election.

He was echoed by Rishi Sunak, the Chief Secretary to the Treasury, who said he did not accept last week’s election gave Ms Sturgeon a mandate for another vote as a majority of Scots voted for Unionist parties.
